regarding the purchasing of Season Tickets, Home Matchday
Tickets, Away Matchday Tickets or Club Merchandise on www.onerovers.co.uk
1. Contract Formation:
1.1 When
you submit your order, you are offering to buy tickets at the price stated in
accordance with the terms and conditions of the specific item(s), which, if
accepted by us, will result in a binding contract. It is therefore important
that you read and accept the terms and conditions before submitting any order.
1.2 Once
you have completed your order, you will be asked to confirm that it is correct.
If it is not, you can amend or cancel the order before submitting it. It is your
responsibility to ensure it is correct before submission. You should note that
payment will be taken when you click the "Pay Now"
button. This does not indicate our acceptance of your offer, and will be
refunded in the unlikely event that we refuse the offer.
1.3 We
will send a confirmation email on receipt of your order. This is not an
acceptance of your offer, but an acknowledgement that we have received the
order, and that our Ticket Office/merchandise department are processing it. The
contract between us will not be formed until we dispatch the tickets/goods to
the address as stated in your order.
1.4 Whilst
we try to ensure that pricing and ticketing information on our website are
correct at all times, errors may occasionally occur. If we discover an error in
the price or nature of the ticket you have ordered, we will inform you as soon
as possible, and give you the option of reconfirming your order at the correct
price/specification or cancelling it. If we are unable to contact you, we will
unfortunately have to treat the order as cancelled. If the order is cancelled,
we will of course provide you with a full refund.
1.
Availability
Although
Blackburn Rovers endeavours to ensure the accuracy of the Products availability
information, occasionally, some Products may be temporarily out of stock or
sold out earlier than anticipated due to unexpected demand. Where any Product
ordered is out of stock, we will inform you of this by telephone or, if you are
outside the UK, by email, and, if possible, offer you alternative Products.
Unless you choose to accept the alternative Product or Products offered to you,
any sum debited by the club from your credit card will be re-credited to your
account and Blackburn Rovers will notify you by email at the email address you
provide in your order form. The refund will be made as soon as possible and, in
any event, within 30 days of the telephone call or the email from Blackburn
Rovers informing you that Products are out of stock.
2.
Price and Payment
All
prices are inclusive of UK VAT at the current rates. Except in the case of
manifest error, the prices payable for Products that you order are as set out
on the Website at the time at which we accept your order. The total cost of
your order is the price of the Products ordered plus the relevant packaging and
delivery costs.
Payment
must be made in £ sterling and may be made by Mastercard, Visa, Electron, Solo
or Switch cards. You confirm that the credit/debit card which is being used is
yours. All credit/debit card holders are subject to validation checks and
authorisation by the card issuer. Blackburn Rovers reserves the right to refuse
credit card payments in its reasonable discretion.
3.
Description of Products
The
Products depicted on onerovers.co.uk are as seen. The reproduction of colours
and styles are as accurate as photographic and image processing will allow. The
Club does not accept responsibility for slight variances in colour and style.
4.
Cancellation and Returns
You
may cancel your order in relation to any unwanted Products at any time up to 14
days after receipt of the relevant Products provided you return the unwanted
Products to us within that time. This right to cancellation of orders does not
apply to Products which have been damaged or tampered with or to custom-printed
shirts or items which have been otherwise personalised. Furthermore if a player
changes his number at any time BRFC cannot offer a refund or exchange on the
shirt (this does not effect your statutory rights). You do not need to give
Blackburn Rovers a reason for cancelling your order nor will you have to pay a
penalty.
To
cancel your order, you must give notice in writing of the cancellation of your
order to Blackburn Rovers at the returns address. Please provide details so
that we can identify both you and your order (including, if possible, details
of your order number as set out in the purchase confirmation emailed to you).
If
you have received the Products before you cancel your order then, unless you
have lost your right to cancel because you have damaged or tampered with the
Products, you must send them back to the Blackburn Rovers returns address by
registered post together with details of your order at your own cost and risk.
If you cancel your order but Blackburn Rovers has already processed the
Products for delivery, you must not unpack the Products when they are delivered
to you and you must send them to the returns address by registered post
together with details of your order at your own cost and risk.
If
the Products which Blackburn Rovers delivers to you are not what you ordered or
are damaged or defective or the delivery is of an incorrect quantity
("Defective Products") and you do not wish to keep them, you must
notify Blackburn Rovers in writing at the Blackburn Rovers returns address of
the problem and return the Defective Products by registered post in an
unused/unworn state within 14 days of delivery.
Provided
that you have notified Blackburn Rovers that you are cancelling your order or
that you are returning defective Products (as the case may be) in accordance
with these conditions of sale, any sums debited by Blackburn Rovers from your
credit card will be re-credited to your account as soon as possible and in any
event within 30 days of receipt by Blackburn Rovers of the notice of
cancellation or the notice of return of defective Products (as the case may
be).
5.
Delivery
Without
exception every 1st order from the onerovers website will be sent to
the invoice address.
The
club has chosen 3 delivery options available for all purchases of retail
products.
If
you select our Next day Delivery option any UK order placed before 12noon
Monday to Thursday will be at your door the next day. Any order placed outside
of these times will be delivered at the 1st available opportunity.
The
courier will arrive with your product to be signed for to ensure it has arrived
safely.
Please
note that 24Hr delivery is not available for certain areas of the UK including highlands and islands. For a full list of available postcodes please contact
our Customer Service team.
Pre-Order
Items If you have placed an order for an item that has a launch date - eg a new
football shirt - we will reserve your stock and hold the entire order until the
day prior to this date. The order will then be sent out on 24 hour delivery for
you to receive on launch day.
Goods
will only be despatched once all items can be despatched, the club does not
operate a part ship payment.

European 3 to 5 day delivery is only available in the following European

your order is outside of our standard delivery conditions, you the club will
contact you via email with the specific details of your order and delivery.
6.
Data Protection
Blackburn
Rovers undertake to comply with all applicable Data Protection legislation from
time to time in force under English law. When you place an order on the
Website, the Club considers the information which you enter to be private and
will use the information only in order to process your order, for statistical
purposes to improve the Website and the services to you, to administer the
Website, and to notify you of products or other information which may be of
interest to you relating to Blackburn Rovers.
7.
Force Majeure
Blackburn
Rovers shall have no liability to you for any delay or failure to deliver the
Products to the extent that such delay or failure to deliver arises from causes
beyond the reasonable control of Blackburn Rovers including, but not limited
to, fire, floods, acts of God, acts or regulations of any governmental or
supranational authority, war, riot, strike, lock-out and industrial disputes.
8.
Waiver
No
waiver by us shall be construed as a waiver of any rights or remedies, or any
subsequent breach of any provision of these Conditions of Sale.
9.
Entire Agreement
These
Conditions of Sale, together with the Terms of Use, current Product prices,
delivery details and contact details on this Website, set out the whole of the
agreement between you and the Club.
Definitions
"Conditions
of Sale"
means
these terms and conditions of sale;
"Product"
means
any products displayed for purchase on this Website through Blackburn Rovers;
"Terms
of Use"
means
the terms governing your use of this Website displayed on the homepage;
"Website"
means

"working
day"
means
a day other than a Saturday or Sunday on which clearing banks are normally open
for business in the City of London;
"you"
means a user of this

Season Ticket
2.1
Terms
and Conditions of use Season 2008 / 2009
The term “Season Ticket ” refers to a Skidata Season Ticket card, which when used
at the turnstile in the appropriate manner (as directed by club stewards and staff)
allows entry to the stadium by electronic means.
2.2
Issue
of Season Ticket
This Season Ticket is issued subject to the rules and regulations of FIFA, UEFA,
The Football Association, The FA Premier League and the Football League in respect
of the relevant competition and Blackburn Rovers Ground Regulations.
2.3
Admission
to the Ground
The use of the Season Ticket to gain entry to the stadium for one or more home league
matches constitutes acceptance of such rules and regulations, and the Ground Regulations.
Blackburn Rovers reserves the right to eject from the stadium any person who fails
to comply with such rules and regulations. Please return the Season Ticket unused
if the terms and conditions of use are unacceptable.
Blackburn Rovers is committed to preventing discrimination in all its fields of
operation and within its stadium, providing an environment free from racial abuse,
harassment, bullying and victimisation. Any Season Ticket holder engaging in such
abuse or harassment will have their Season Ticket confiscated and be banned from
attending future games involving Blackburn Rovers. No refunds will be issued.
It is a breach of Ground Regulations to stand in seated areas during play except
for the purposes of access and egress. No person may stand in a seated area whilst
play is in progress. Persistent standing in seated areas is strictly forbidden and
a breach of the Ground Regulations. This may result in ejection from the ground,
and lead to the confiscation of the Season Ticket.
If a supporter is prosecuted for any criminal offence the Club reserves the right
to confiscate their Season Ticket.
Your entry to the stadium is conditional upon your consent to be searched by the
Police or Club Stewards.
The use of radios is not permitted in the ground unless with a suitable earpiece.
No person may bring into the stadium or use within the stadium any equipment that
is capable of recording or transmitting (by digital or other means) any audio, visual
or audio-visual material or any information or data in relation to a match or the
stadium.
Mobile telephones are permitted within the stadium provided that they are used for
personal and private use only.
2.4
Use
of the Season Ticket
The Season Ticket admits the holder to all first team home league matches. For all
home cup matches and play-off matches, if the area of the stadium in which your
seat is located is open for that match, your seat will be reserved but you will
have to purchase it within the timescale notified for the match. If the area of
the stadium in which your seat is located is not available, you will be given priority
to purchase a ticket in another area.
The Season Ticket admits the holder to all home matches in the Premier Reserve League
or its equivalent, and to home Youth Cup matches up to and including the Semi-Final.
The Season Ticket must be produced at the turnstile to gain entry.
Admission to testimonial and friendly matches is not included within the Season
Ticket.
The Season Ticket remains the property of Blackburn Rovers Football Club at all
times and its use is subject to compliance with the terms and conditions set out
below. This Season Ticket must be produced for inspection at the request of the
club or its agents. Refunds are at the discretion of the Club and will only be considered
upon written request to the Ticket Office.
In order to gain access to the stadium the Season Ticket must be presented and used
at the turnstile in the appropriate manner as directed by club stewards and staff.
You are advised to take your position not less than 30 minutes prior to the designated
kick-off time.
Throughout the season it is the club’s intention to run promotional activities at
selected fixtures.
Blackburn Rovers Customer Charter covers the Club’s policy on refunds or exchanges
and pricing for seats with a restricted view of the pitch.
Season Ticket Holders will have preference for the purchase of tickets for away
matches and Cup Finals, provided that they apply within the timescales notified
for such matches and fulfil any other requirements determined by the Club. For away
matches, when anticipated demand from Season Ticket holders is greater than our
ticket allocation, the Club will introduce criteria that gives priority to those
supporters who attend away matches on a regular basis.
SEASON TICKETS ARE NON-TRANSFERABLE. However if a Season Ticket Holder wishes to
transfer their seat or upgrade for a specific match, we strongly recommend that
the application be made 24 hours before kick-off. For security reasons the Ticket
Office will require the Season Ticket, or the customer account number at the time
the request is made. If a transfer or upgrade request is made on the day of the
match, due to the demands on the Ticket Office, there may be a delay whilst your
request is dealt with. In the case of a concessionary ticket being used by an adult
or senior, the notification of change must be accompanied by a fee equal to the
difference between the applicable full match day price for that seat, and the average
price per match paid for the Season Ticket.
The Club will offer an upgrade service at its discretion and reserves the right
to withdraw the facility if it suspects that the system is being abused. A Junior/Under
8 Season Ticket can only be upgraded to an adult on a maximum of four occasions
in one season.
Qualifying ages for concessionary Season Tickets are: - Juniors are aged 15 years
or under on 31/8/2008; Young Adults are aged between 16 – 21 years on 31/8/2008;
Seniors are aged 65 years or over on 01/9/2008; Under 8s are aged 7 years and under
on 31/8/2008. Free Under 8 Season Tickets are only available to those supporters
who held a Free Under 8 Season Ticket for Season 2007/2008. A Free Under 8 Season
Ticket cannot be transferred to another person.
Free Under 8 Season Tickets can only be claimed with a full paying adult, and must
be seated with the adult. There is a maximum of two free Under 8 Season Tickets
per adult Season Ticket Holder. The child named on the application form must use
the ticket.
The Rovers Junior
Season Ticket will be referred to as the 'Team Rovers Season Ticket' (15 and under)
from season 2008/09. All Juniors will be required to submit a passport photo when
renewing/purchasing a Team Rovers Season Ticket unless they have already submitted
one this season. Team Rovers Season Ticket Holders, for whom we do not have a photo
will not receive their free membership pack until receipt of photo.
Family stand season ticket holders please note, should the stadium be reaching capacity
for any game the club reserves the right to sell tickets in the family stand to
known individuals on the club database.
If a Season Ticket holder wishes to transfer their seat into another area of the
ground for an individual match, this will incur a charge if the Season Ticket price
in that area is greater than the value of the Season Ticket. For security reasons
the Ticket Office will require the Season Ticket or the customer account number
at the time the request is made. The charge will be calculated in the same manner
as an upgrade. Requests to transfer for individual matches should only be made in
exceptional circumstances.
Supporters purchasing by Direct Debit are subject to the additional terms and conditions
applicable to that scheme. The Direct Debit Scheme involves 10 monthly instalments
starting from the 1st June 2008. Failure to maintain the Direct Debit payments will
result in the cancellation of the season ticket.
Executive Area Season Tickets (including “Legends” Inside Viewing) admit the holder
to all first team home league matches; cup matches, play-off, home reserve and youth
team matches. For home reserve and youth team matches access is to stand seating
in designated areas only. Admission to testimonial and friendly matches is NOT included
within the Executive Area Season Ticket.
All Executive Area Season Ticket holders are requested to wear a good standard of
dress – Jacket and collar (tie optional) for gentlemen with comparable dress for
ladies. Denims, trainers or team colours are not permitted in the lounges. Entrance
will be refused to anyone not complying with this requirement.
Supporters are reminded that smoking is not permitted in the seating areas of the
Stadium. Persons failing to conform to this particular Ground Regulation may be
ejected and their Season Ticket forfeited.
Supporters using the Home Cup Ticket Payment scheme or the Away Match Season Ticket
are subject to the terms and conditions applicable to those schemes.
2.5 Changes to Dates,
Refunds & Exchanges
The Club reserves the right to change its advertised fixtures without notice and
without liability. Play cannot be guaranteed to take place on a particular day or
at any particular time. It is the responsibility of the Season Ticket Holder to
ascertain the date and kick off time of any fixture.
NO REFUNDS can be given under any circumstances for individual matches that the
Season Ticket holder cannot attend. The club cannot guarantee that your seat will
not be affected by adverse weather conditions. Blackburn Rovers excludes to the
maximum extent permitted by law any liability for loss, injury or damage to persons/property
in or around the ground.
2.6 Lost or Stolen Season Tickets
Duplicate Season Tickets: It is the responsibility of the Season Ticket Holder to
ensure that the Season Ticket is kept safe at all times. In the event of the Season
Ticket being lost or stolen the club will charge a non-refundable administration
fee of £10 per Season Ticket, regardless of the cost of the Season Ticket or how
many games have been played. Notification of a lost Season Ticket must be made in
writing to the Ticket Office by the Season Ticket Holder (their parent or guardian
in respect of a junior).
Damaged Season Tickets: A replacement Season Ticket will incur a non-refundable
administration charge of £10, regardless of the cost of the Season Ticket. It is
the responsibility of the Season Ticket Holder to ensure the Season Ticket remains
in good condition. If the face of the Season Ticket becomes defaced or damaged,
thus making the Season Ticket details illegible, a replacement Season Ticket must
be issued at the Season Ticket Holders cost.
Duplicate match tickets in respect of a Season Ticket left at home in error on the
day of a home match, will be issued through the Ticket Office upon payment of a
non-refundable administration charge of £2 per ticket. Such a request must be made
in person at the Ticket Office by the Season Ticket Holder (their parent or guardian
in respect of a junior)
Supporters utilising the seat upgrade facility, transfer facility, obtaining duplicate
Season Tickets, or supporters who default on the direct debit instalment plan should
note: - The Skidata system enables Blackburn Rovers to cancel a Season Ticket for
a single game or for the remaining games at any point during the season. Once
a card is cancelled it will no longer activate the turnstile. This will prevent
it being used to gain access to the stadium.
2.7 Change of Address
If you change your address during the season, please advise the Ticket Office in
writing for security reasons, and to enable the Club to keep their records up to
date.
2.8 Cancellation & Withdrawal of Season Ticket
Stewards or other agents of the Club are empowered to confiscate any Season Ticket
that has been subject to misuse or its user is in breach of any term and conditions
or the ground regulations.
Supporters are reminded that it is a criminal offence to (a) enter upon the field
of play, (b) chant foul and abusive or racist remarks, (c) throw any objects towards
the playing area or other areas of the stadium, (d) be in possession of intoxicating
liquor or illegal substances during play whilst in view of the pitch or whilst entering
the ground, (e) be drunk whilst entering or attempting to enter the ground. THESE
ARE ARRESTABLE OFFENCES.

abuse or harassment will have their Season Ticket confiscated and be banned from

to confiscate their Season Ticket.
In the event that your Season Ticket is withdrawn or cancelled the Club reserves
the right to exclude the Season Ticket Holder from any membership scheme maintained
or organised by the Club and/or to disqualify you from applying for any Match ticket
or Season ticket at its discretion, including Away Travel.
Home Matchday Tickets
1.
Issue of Home Match
Ticket
1.1
The
issue of a Home Match Ticket and subsequent access to the Ground is subject to the
Terms & Conditions of Entry.
1.2
Home
Match Tickets are for the use of supporters of the Club only. By applying for the
Home Match Ticket and/or using the same you hereby warrant and represent that you
are a supporter of the Club.
2.
Admission to the Ground
2.1
Use
of the Home Match Ticket constitutes acceptance of the Terms & Conditions of
Entry.
2.2
A Home
Match Ticket permits you to occupy at the Match the seat indicated on the Home Match
Ticket or such other alternative seat of equal price as the Club may allocate to
you at its reasonable discretion.
2.3
Nothing
in these Conditions of Issue shall constitute or imply any entitlement to occupy
the seat indicated on the Home Match Ticket in any subsequent Match or season.
2.4
Save
as set out in clause 2.5 below, you shall not bring into (or use within) the Ground
any equipment which is capable of recording or transmitting (by digital or other
means) any audio, visual or audio-visual material or any information or data in
relation to a Match or any aspect of it. Any person acting in breach of this provision
will be required to deliver up any tapes, films, disks or other recordings or data
to the Premier League and/or the Club and the copyright in any such recording or
transmission is herby assigned (by way of present assignment of future copyright
pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Premier
League.
2.5
Mobile
telephones are permitted within the Ground, provided that they are used for personal
and private use only.
2.6
Save
for official Club merchandise and/or other football related clothing worn in good
faith, you shall not bring into, use or display within the Ground any sponsorship,
promotional or marketing materials.
2.7
You
shall not offer or distribute (either free or for sale by any person) within the
Ground any consumer article or commercial product of any nature. For the avoidance
of doubt this clause shall not prevent the lawful distribution of text publications
in any format which do not infringe clause 2.6 where both the content and the publication
are lawful in all respects and do not in the Club’s reasonable opinion constitute
a threat to public order.
2.8
The
Club reserves the right to refuse admission to, or eject from, the Ground any person
who fails to comply with the Terms & Conditions of Entry.
3.
Use of Home Match Ticket
3.1
The
Home Match Ticket is issued for your sole use and you shall not resell, assign or
(save as set out in clause 3.3 below) transfer the Home Match Ticket or the benefit
of it to any other person without the prior written consent of the Club. The reference
to reselling the Home Match Ticket includes reference to offering to sell a Home
Match Ticket, exposing a Home Match Ticket for sale, making a Home Match Ticket
available for sale by another and advertising that a Home Match Ticket is available
for purchase. For the avoidance of doubt (and by way of example only) this Home
Match Ticket may not be offered as a prize in any promotion or competition or transferred,
lent or sold to any third party as part of a hospitality or travel package, given
to a third party who agrees to buy another good or service or used for any other
commercial purpose save as expressly authorised by the PL or the Club.
3.2
The
unauthorised sale or disposal of tickets is a criminal offence under section 166
of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime
Reduction Act 2006. The Club will inform the police when it becomes aware that tickets
are being sold illegally and will press for charges to be brought against those
breaking this law.
3.3
If
more than one Home Match Ticket is issued to you one Home Match Ticket must be retained
by you for personal use (subject to the provisions below) and the remainder may
be transferred to your Guest(s) for his/her personal use only PROVIDED THAT
such transfer takes place in consideration of no payment or benefit in excess of
the face value of the Home Match Ticket, and such transfer does not take place in
the course of any business or for the purpose of facilitating any third party’s
business. Such transfer to any Guest will be subject to the Terms & Conditions
of Entry which will (save for any rights to transfer under this clause or any rights
to a refund under clause 4.3) apply to the Guest as if he were the original purchaser
of the Home Match Ticket (and you must inform the Guest of this). You will provide
the name and address of your Guest(s) when asked to do so by any official, steward
or employee of the Club or any police officer. In the event that you and/or your
Guest are unable to use any Home Match Ticket then you may transfer that Home Match
Ticket(s) to a natural person who is known to you personally who would be entitled
(under the Terms & Conditions of Entry) to purchase such Home Match Ticket and
attend such Match PROVIDED THAT such transfer takes place in consideration
of no payment or benefit in excess of the face value of the Home Match Ticket, and
such transfer does not take place in the course of any business or for the purpose
of facilitating any third party’s business. Such transfer will be subject to the
Terms & Conditions of Entry which will (save for any rights to transfer under
this clause or any rights to a refund under clause 4.3) apply to the transferee
as if he were the original purchaser of the Home Match Ticket (and you must inform
the transferee of this). You will provide the name and address of the transferee
when asked to do so by any official, steward or employee of the Club or any police
officer.
3.4
The
Home Match Ticket will remain the property of the Club at all times and must be
produced together with evidence of your identity if required to do so by any official,
steward or employee of the Club or any police officer. The Club reserves the right
to require the immediate return of the Home Match Ticket at any time.
3.5
Any
Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry
shall be automatically void and all rights conferred or evidenced by such Home Match
Ticket shall be nullified. Misuse of this Home Match Ticket may result in the holder
being refused entry to, or ejected from, the Ground in respect of a particular Match
and/or the cancellation and withdrawal of this Home Match Ticket. In the event of
any cancellation and withdrawal in accordance with this clause 3.5, no refund shall
be payable. The Club further reserves its right to take any legal action against
any persons as it sees fit in connection with such matters, including a claim for an account of profits made
from an unauthorized use of the Home Match Ticket.
4.
Changes to Dates, Refunds & Exchanges
4.1
No
guarantees can be given by the Club that the Match will take place at a particular
time or on a particular date. The Club reserves the right to reschedule any Match
without notice and without any liability whatsoever, other than that detailed in
Clause 4.2.
4.2
In
the event of the postponement or abandonment of the Match, you will be entitled
to receive a full refund or receive the equivalent ticket for the subsequent re-arranged
Match via such application procedure as the Club stipulates. The Club will have
no further liability whatsoever, including (but not limited to) any indirect or
consequential loss or damage, loss of enjoyment or travel costs.
4.3
In
order to obtain a refund, the Home Match Ticket must be returned to the Club’s ticket
office no later than 24 hours before the commencement of the Match. A refund will
only be issued on production of identification that the individual requesting the
refund is the person to whom the Home Match Ticket was originally sold. For the
avoidance of doubt, the final decision belongs to the Ticket Office Manager.
5.
Lost or Stolen Home Match Tickets
5.1
In
order to gain admission to the Ground the Home Match Ticket must be presented in
its entirety at the Match.
5.2
The
Club shall not be obliged to issue any replacement for a lost, stolen or destroyed
Home Match Ticket.
6.
Cancellation & Withdrawal of Home Match Ticket
6.1
Without
prejudice to any other remedies it may have, the Club shall have the right in the
case of any serious or persistent breach of the Terms & Conditions of Entry
to cancel and withdraw any Home Match Ticket issued to you. In the event of such
cancellation no refund will be paid. Without prejudice to the general nature of
the above the following actions shall constitute serious breach of the Terms &
Conditions of Entry:
6.1.1
smoking
in designated non-smoking areas;
6.1.2
persistent
standing in seated areas whilst the Match is in progress;
6.1.3
sale
or transfer (save as permitted) of this Home Match Ticket to any person;
6.1.4
deliberate
misuse of the Home Match Ticket;
6.1.5
any
misrepresentation in relation to clause 1.2;
6.1.6
persistent
swearing during the Match;
6.1.7
the
throwing of any object within the Ground without lawful authority or excuse;
6.1.8
the
chanting of anything of an indecent or racist nature;
6.1.9
the
supply of any misleading or incorrect information in any application;
6.1.10
any
failure to pay or default of payment in respect of any sums owing to the Club (or
any third party) in respect of a Home Match Ticket.
6.2
In
the event that your Home Match Ticket is withdrawn or cancelled the Club reserves
the right to exclude you from any membership scheme maintained or organised by the
Club and/or to disqualify you from applying for any Match ticket or season ticket
at its discretion.
7.
Exclusion of Liability
To the maximum extent
permitted by law, the Club hereby excludes any liability for loss, injury or damage
to persons/property in or around the Ground.
8.
Governing Law
These Conditions
of Issue shall be governed by and construed in accordance with the laws of England
and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts
of England and Wales.

What is WEEE?
The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries
to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a
system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their
own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.

9.
Definitions
In the Conditions
of Issue the following words and phrases shall have the following meanings:
"Conditions
of Issue"
means these terms and conditions governing the issue and use of a Home Match Ticket.
"Ground" means the football
Ground and all other locations owned, occupied or utilised by the Club.
"Ground Regulations" means those ground
regulations issued by the Club from time to time that set out the terms and conditions
upon which spectators are granted entry to the Ground (copies of which are enclosed).
“Guest”
means a relative,
friend, colleague and/or companion to the disabled who would be entitled to purchase
a Home Match Ticket under the Terms and Conditions of Entry.
"Match" means any Premier
League football match in which the Club participates and that takes place at the
Ground during Season 2008-2009.
"Home Match
Ticket"
means a printed paper
ticket or other form of ticket (and/or
any rights arising out of or in connection with the foregoing) for admission to
a Match.
"Terms &
Conditions of Entry"
means each of the rules and regulations of FIFA, UEFA, The Football Association,
The Premier League (“PL”), and The Football League; the Ground Regulations;
and the Conditions of Issue.
Away Ticket
10.
Issue of Away Match
Ticket
10.1
The
issue of an Away Match Ticket and subsequent access to the Ground is subject to
the Terms & Conditions of Entry.
10.2
Away
Match Tickets are for the use of supporters of the Visiting Club only. By applying
for an Away Match Ticket and/or using the same you hereby warrant and represent
that you are a supporter of the Visiting Club.
11.
Admission to the Ground
11.1
Use
of an Away
Match Ticket constitutes acceptance of the Terms & Conditions of Entry.
11.2
An
Away Match
Ticket permits you to occupy the seat indicated on the Away Match Ticket or such
other alternative seat of equal price as the Club may allocate to you at its reasonable
discretion.
11.3
Save
as set out in clause 2.4, you shall not bring into (or use within) the Ground any
equipment which is capable of recording or transmitting (by digital or other means)
any audio, visual or audio-visual material or any information or data in relation
to the Match or any aspect of it. Any person acting in breach of this provision
will be required to deliver up any tapes, films, disks or other recordings or data
to the Premier League and/or the Club and the copyright in any such recording or
transmission is herby assigned (by way of present assignment of future copyright
pursuant to section 91 of the Copyright, Designs, and Patents Act 1988) to the Premier
League.
11.4
Mobile
telephones are permitted within the Ground, provided that they are used for personal
and private use only.
11.5
Save
for official Club merchandise and/or other football related clothing worn in good
faith, you shall not bring into, use or display within the Ground any sponsorship,
promotional or marketing materials.
11.6
You
shall not offer or distribute (either free or for sale by any person) within the
Ground any consumer article or commercial product of any nature. For the avoidance
of doubt this clause shall not prevent the lawful distribution of text publications
in any format which do not infringe clause 2.5 where both the content and the publication
are lawful in all respects and do not in the Club’s reasonable opinion constitute
a threat to public order.
11.7
The
Club reserves the right to refuse admission or eject from the Ground any person
who fails to comply with the Terms & Conditions of Entry.
12.
Use of Away Match Ticket
12.1
The
Away Match Ticket is issued for your sole use and you shall not resell, assign or
(save as set out in clause 3.3) transfer the Away Match Ticket or the benefit of
it to any other person without the prior written consent of the Club. The reference
to reselling the Away Match Ticket includes reference to offering to sell a Away
Match Ticket, exposing a Away Match Ticket for sale, making a Away Match Ticket
available for sale by another and advertising that a Away Match Ticket is available
for purchase. For the avoidance of doubt (and by way of example only) this Away
Match Ticket may not be offered as a prize in any promotion or competition or transferred,
lent or sold to any third party as part of a hospitality or travel package, given
to a third party who agrees to buy another service or goods, or used for any other
commercial purpose, save as expressly authorised by the Premier League or the Club.
12.2
The
unauthorised sale of tickets is illegal under section 166 of the Criminal Justice
and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The
Club will inform the police when it becomes aware that Away Match Tickets are being
sold illegally and will press charges to be brought against those breaking this
law.
12.3
If
more than one Away Match Ticket is issued to you, one Away Match Ticket must be
retained by you for personal use (subject to the provisions below) and the remainder
may be transferred to your Guest(s) for his/her personal use only PROVIDED THAT
such transfer takes place in consideration of no payment or benefit in excess of
the face value of the Away Match Ticket and such transfer does not take place in
the course of any business or for the purpose of facilitating any third party’s
business. Such transfer to any Guest will be subject to the Terms & Conditions
of Entry which will (save for any rights to transfer under this clause or any rights
to a refund under clause 4.3) apply to the Guest as if he/she was the original purchaser
of the Away Match Ticket (and you must inform the Guest of this). You will provide
the name and the address of your Guest(s) when asked to do so by any official, steward
or employee of the Club and/or any police officer. In the event that you and/or
your Guest are unable to use any Away Match Ticket then you may transfer that Away
Match Ticket(s) to a natural person who is known to you personally who would be
entitled (under the Terms & Conditions of Entry) to purchase such Away Match
Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration
of no payment or benefit in excess of the face value of the Away Match Ticket, and
such transfer does not take place in the course of any business or for the purpose
of facilitating any third party’s business. Such transfer will be subject to the
Terms & Conditions of Entry which will (save for any rights to transfer under
this clause or any rights to a refund under clause 4.3) apply to the transferee
as if he were the original purchaser of the Away Match Ticket (and you must inform
the transferee of this). You will provide the name and address of the transferee
when asked to do so by any official, steward or employee of the Club or any police
officer.
12.4
The
Away Match Ticket will remain the property of the Club at all times and must be
produced together with evidence of your identity if required to do so by any official,
steward or employee of the Club or any police officer. The Club reserves the right
to require the immediate return of the Away Match Ticket at any time.
12.5
Any
Away Match
Ticket obtained
or used in breach of the Terms & Conditions of Entry shall be automatically
void and all rights conferred or evidenced by such Away Match Ticket shall be nullified. Misuse of this
Away Match
Ticket may
result in the holder being refused entry to, or ejected from, the Ground in respect
of the particular Match and/or the cancellation and withdrawal of this
Away Match
Ticket. In the event
of any cancellation and withdrawal in accordance with this clause 3.5, no refund
shall be payable. The Club further reserves its right to take any legal action against
any person(s) as it sees fit in connection with such matters, including a claim
for an account of profits made from an unauthorized use of the Away Match Ticket.
13.
Changes to Dates, Refunds & Exchanges
13.1
No
guarantees can be given by the Club that the Match will take place at a particular
time or on a particular date. The Club reserves the right to reschedule the Match
without notice and without any liability whatsoever.
13.2
In
the event of the postponement or abandonment of the Match, you will be entitled
to receive a full refund or receive the equivalent ticket for the subsequent re-arranged
Match via such application procedure as the Club stipulates. The Club will have
no further liability whatsoever, including (but not limited to) any indirect or
consequential loss or damage, loss of enjoyment or travel costs.
13.3
In
order to obtain a refund, the Away Match Ticket must be returned to the Club’s ticket
office no later than 24 hours before the commencement of the Match. A refund will
only be issued on production of identification that the individual requesting the
refund is the person to whom the Away Match Ticket was originally sold. For the
avoidance of doubt, the final decision belongs to the Ticket Office Manager.
14.

means each of the rules and regulations of FIFA, UEFA, The Football Association
and The Premier League; the Ground Regulations; and the Conditions of Issue
(all of which are available from the Club on request).
"Away Match
Ticket"
means a printed paper
ticket or any ticket smartcard (and/or
any rights arising out of or in connection with any of the foregoing) for admission
to the Match.
"Visiting
Club"
means the football club playing against the Club.
